Understanding Paid Sick Leave Rights for Farmworkers

Did you know that by law in the state of California, employees receive paid sick leave? This benefit is crucial for your wellbeing and they can be used to:


  • Rest and recover from being sick

  • Cover doctor appointments

  • Take care of a relative who is sick


Please note: Sick leave is not vacation. You cannot use your sick leave hours to take a vacation.


This benefit applies regardless if you are full time, part time, or seasonal. Your sick hours should be listed in your pay stub.

  • Work at least 30 days with the same employer

  • You can start using it after working for 90 days


How do I use my sick leave?

  • You can let your employer know either in writing or verbally that you don't feel well or that you are taking care of a sick relative

  • A doctor's note is not required

  • You are not responsible for finding someone to cover you



If you have questions, talk to your supervisor or human resources

It is against the law for your employer to deny you sick leave or punish you for using sick leave.


If you have been a victim of retaliation or have been denied your sick leave, file a claim, call the labor commissioners office
